About Dale Ho

President Biden nominated Dale Ho to the United States District Court for the Southern District of New York on September 20, 2021.

As one of the nation’s premier civil rights and voting rights attorneys, Mr. Ho has spent his career fighting for our most critical constitutional rights and legal protections, and is eminently qualified to serve as a federal judge. An accomplished litigator, Mr. Ho has extensive experience litigating at every level of the federal court system, including twice arguing before the U.S. Supreme Court.

Since 2013, Dale Ho has acted as director of the ACLU’s Voting Rights Project advocating on behalf of the constitutional rights of voters, regardless of political party. Mr. Ho has successfully challenged racially discriminatory voting restrictions, and successfully challenged the Trump administration’s attempt to add a citizenship question to the 2020 census. As he effectively argued before the Supreme Court, the Trump administration’s citizenship question would have deterred millions of noncitizens and their families from participating in the census, potentially skewing the distribution of federal resources, as well as representation in Congress for a decade.

The Southern District, which includes the boroughs of the Bronx and Manhattan and the northern NYC suburbs, covers one of the most populated and racially diverse regions in the entire nation. If confirmed, Dale Ho would be the only Asian American Pacific Islander (AAPI) man sitting on the Southern District of New York.

About Nancy Abudu

President Biden nominated Nancy Gbana Abudu to the United States Court of Appeals for the Eleventh Circuit on January 10, 2022. 

Ms. Abudu has led all aspects of complex litigation in both state and federal courts and is a leading civil rights litigator and voting rights expert. Ms. Abudu’s robust appellate practice has included representation before the U.S. Supreme Court and numerous federal circuit courts of appeal. Her career has been dedicated to protecting the rights of all people, and she is eminently qualified to serve as a federal judge.

In 2005, Ms. Abudu joined the American Civil Liberties Union’s (ACLU) Voting Rights Project located in Georgia. At the ACLU’s Voting Rights Project, she argued cases to protect the fundamental right to vote before the U.S. Court of Appeals for the Fifth, Ninth, and Eleventh Circuits. In 2013, she was hired as Legal Director for the ACLU of Florida, where she managed litigation on a wide range of civil rights issues, including free speech, religious freedom, and employment discrimination. Ms. Abudu was hired in 2019 as Deputy Legal Director for the Southern Poverty Law Center, headquartered in Alabama. There, she spearheaded the creation of the Center’s Voting Rights Practice Group and supervised litigation in the U.S. Court of Appeals for the Fifth and Eleventh Circuits. She also currently serves as the organization’s Director for Strategic Litigation.

Ms. Abudu’s work as a civil rights litigator has touched every state in the Eleventh Circuit. If confirmed, she would be the first Black woman on the Circuit and the first person of color from Georgia to serve on this court. She has worked tirelessly to protect the fundamental right to vote and she has also worked extensively on the issue of felony disfranchisement.  Ms. Abudu has also represented plaintiffs in reproductive rights and LGBTQ+ rights matters, and she has has worked to protect the rights of those accused and convicted in criminal court.

The Stakes of The Nomination

Republican-appointed judges have been central to their party’s efforts to make it harder for communities of color and young people to vote. They have gutted the Voting Rights Act, upheld partisan gerrymanders and green lit purging voters of color from registration rolls. The confirmation of Dale Ho, Nancy Abudu, and other Biden nominees, are crucial for ensuring our courts are not rigged in favor of those who seek to dismantle core tenets of our democracy.
