Donald Trump nominated Brett Kavanaugh for a seat on the United States Supreme Court on July 9, 2018. Kavanaugh’s confirmation would pose an unacceptable risk to many critical legal rights and protections for millions of people in the United States.
We know that Donald Trump had two key litmus tests for Supreme Court nominees: that they be people who would vote to overturn and gut Roe v. Wade and undermine the Affordable Care Act. Kavanaugh’s record shows that he fits the bill.
In the now-famous “Jane Doe” case, Kavanaugh tried to block an undocumented minor detained by the government from exercising her constitutional right to an abortion, dissenting from the D.C. Circuit opinion allowing her to seek the care she needed.
Kavanaugh believes the president should be above the law, an especially troubling position as investigations into the Trump Administration’s possible collusion with Russia and criminal acts. He has said that the president should have “absolute discretion” to determine whether and when to appoint a special counsel like Robert Mueller. Kavanaugh would be a rubber stamp for Trump’s agenda, not the much-needed check on the executive branch.
We also know that Trump turned to two ultraconservative interest groups, the Heritage Foundation and the Federalist Society, to identify potential Supreme Court nominees. Kavanaugh’s name was pulled from that list; proof that these groups believe they can rely on him to advance their agendas – not ours.
Our federal courts, especially the Supreme Court, should uphold the rights of all, not just the wealthy and powerful. This is especially true now, when the Trump Administration is working to roll back decades of progress on civil and human rights. Real people are suffering every day because of this administration’s policies. We can’t allow Donald Trump to give a lifetime seat on the Supreme Court to another person who will march in lockstep with his agenda.
