New Report Highlights Growing National Focus on State Supreme Courts

State supreme courts have always played a huge role in determining our rights and freedoms, but in the wake of massive U.S. Supreme Court decisions sending issues like reproductive freedom and access to democracy back to states, their role is in the national spotlight more than ever. A new report from the Alliance for Justice Action Campaign highlights the increasing focus on state court elections and some of the major cases these courts are handling.

2024 in State Supreme Court Races

“We’re looking at upwards of 80 state supreme court elections in more than 30 states next year. This is going to be one of the biggest years for state Supreme Court elections. We have several states where partisan control of those deeds could be determined. Some of this will depend on whether real competitors file against incumbents and for open seats, and whether, in states with retention elections, real campaigns are mounted to challenge the justices who are up,” explained Jake Faleschini, legal director for state courts at the Alliance for Justice Action Campaign, a group aiming to ensure courts reflect the values of the American people.

Today Alliance for Justice and Alliance for Justice Action Campaign launched their largest-ever joint digital media ad buy to bring attention to the urgent need for Supreme Court Justice Clarence Thomas to resign because he broke the law and abused his power. The $400,000 campaign consists of video ads and banners that will appear online in major national outlets, including The New York Times, Washington Post, CNN, Politico, Fox, and The Hill.

AFJ Action Praises New York Court of Appeals Nominations

Today New York Gov. Kathy Hochul announced two nominations to the New York State Court of Appeals. Associate Judge Rowan Wilson has been nominated for a promotion to Chief Judge, and Caitlin Halligan will then be nominated to succeed him as Associate Judge. These nominations followed the failed nomination of Justice Hector LaSalle, who the New York Senate rejected for his conservative record.

Conservatives Admit to Directly Lobbying Judges to Get the Result They Want

In the last week of January, the Washington Supreme Court heard oral arguments in a case in which a group of wealthy conservative activists are challenging a capital gains tax passed by the Washington state legislature. In their attempts to defeat the tax, which is expected to bring in about $500 million that will fund early childhood education in the state, one group has admitted to openly attempting to lobby the justices on that court.
