‘To their own peril’: 2020 Democrats sidestep fight for Supreme Court

Dan Goldberg, legal director for the Alliance for Justice Action Campaign, pushed back, saying liberal voters are galvanized like never before on the issue of judicial nominations. A poll conducted for Alliance for Justice Action Campaign and other groups last June revealed 43% of likely 2020 voters said a Supreme Court appointment is a reason to back a Democratic nominee, while only 35% said it is a reason to vote for Mr. Trump. “Both polling and on the ground experience demonstrates that progressive voters are galvanized like never before on the issue of courts. You saw this during Kavanaugh,” he said.

At Friday night’s debate, several candidates discussed the importance of the courts and their support for judicial nominees that would uphold the right to an abortion. On December 20th, the Fifth Circuit Court of Appeals ruled on the Republican-led lawsuit to repeal the Affordable Care Act (ACA). Two Republican-appointed judges, Jennifer Elrod and Kurt Engelhart (whose records our sister organization, Alliance for Justice Action Campaign, scrutinized prior to their confirmations) sided with President Trump to declare a portion of the law unconstitutional, while the one Democrat-appointed judge on the panel dissented.

Yet, with few exceptions, Democrats rarely make clear that they, too, recognize how critical judges are,” said Daniel Goldberg, legal director at Alliance for Justice Action Campaign. “Most Americans, if they knew their horrific records, would not support Trump’s nominees, and Democrats can do a better job of highlighting the damage they are already doing to the rule of law.”




AFJAC Calls on Democratic Candidates to Prioritize Judges in Tonight’s Debate

The Senate has confirmed many of President Trump’s judicial nominees, including those who are extreme ideologues and unqualified jurists. In advance of tonight’s Democratic primary debate, Alliance for Justice Action Campaign President Nan Aron released the following statement: “We have seen Senate Republicans repeatedly rubber-stamp Trump’s judicial nominees, even when they have no experience in the courtroom or when they have extreme beliefs that would turn back the clock on the rule of law."
